TERMS OF USE – UNINSURANCE
Welcome to Uninsurance (“Uninsurance”, “we”, “us”, or “our”).
These Terms of Use govern your access to and use of the Uninsurance website, platform, services, tools, and communications (“Platform”).
By using the Platform, you agree to these Terms. If you do not agree, you must refrain from using the Platform.
1. Nature of the Platform
1.1 Uninsurance is a referral and facilitation platform assisting individuals involved in motor vehicle incidents where:
- they do not have insurance;
- they elect not to claim from insurance;
- their insurance claim has been rejected; or
- they require assistance with vehicle-related legal recoveries or liabilities.
1.2 The Platform collects information relating to vehicle incidents and applies an automated assessment methodology to generate an indicative score or outcome, including:
- Green;
- Amber; or
- Red.
1.3 The generated assessment is merely an indicative risk or merit assessment based on available information and does not constitute:
- legal advice;
- a legal opinion;
- an admission of liability;
- a rating on possible success; or
- confirmation that any claim or defence could possibly succeed.
1.4 Users may be referred to PVW Attorneys Inc, being a fully licensed and registered South African law firm specialising in:
- insurance law;
- motor vehicle accident claims;
- recoveries;
- liability defence; and
- related litigation services.
1.5 Uninsurance itself is not a law firm and does not provide legal representation unless expressly stated otherwise.
2. Referral Services
2.1 Uninsurance acts as a referral and facilitation platform only.
2.2 Any legal services rendered are provided by independent legal practitioners or firms, primarily PVW Attorneys Inc.
2.3 Any attorney-client relationship arises solely between the user and the appointed legal practitioner or law firm.
2.4 Acceptance of any matter remains subject to:
- conflict checks;
- legal merit assessments;
- jurisdictional requirements;
- availability of resources; and
- conclusion of formal mandates or fee agreements.
3. Membership Fees and Nature of Service
3.1 The Platform may operate on a monthly membership or subscription basis in terms of which users obtain access to the services, benefits, assessments, referral functionality, and related support offered through the Platform during the applicable membership period.
3.2 Users acknowledge and agree that the monthly membership fee operates similarly to the structure of a traditional insurance-type membership model, in that:
- the fee grants access to the services and benefits available during the applicable monthly period;
- the service and access benefits exist for the duration of the paid membership period irrespective of whether a claim is ultimately pursued, successful, or concluded;
- the value of the membership is derived from access to the Platform, assessments, support, referral functionality, legal network availability, and associated services during the membership period.
3.3 Users expressly acknowledge that the monthly membership fee is not:
- a deposit;
- a trust investment;
- a guarantee fee; or
- a payment linked solely to a successful outcome or recovery.
3.4 Access to services and Platform functionality may be suspended or terminated where membership fees are unpaid.
3.5 Nothing contained herein shall be interpreted as creating an insurance policy, underwriting arrangement, or regulated financial product unless expressly stated otherwise.
4. No Guarantee
4.1 Uninsurance does not guarantee:
- recoveries;
- settlements;
- legal success;
- acceptance of matters;
- institution of proceedings; or
- favourable outcomes.
4.2 Users acknowledge that all legal matters involve risk and uncertainty.
5. User Obligations
5.1 Users warrant that all information submitted is:
- true;
- accurate;
- complete; and
- not misleading.
5.2 Users may not:
- submit fraudulent claims;
- impersonate another person;
- misuse the Platform;
- interfere with the Platform’s functionality; or
- upload unlawful or malicious material.
5.3 Uninsurance reserves the right to suspend or terminate access where abuse, fraud, or unlawful conduct is suspected.
6. Automated Assessments and Scoring
6.1 The Platform utilises automated systems, algorithms, and assessment methodologies to provide indicative claim assessments.
6.2 Users acknowledge that:
- assessments are probabilistic and automated in nature;
- scores are based solely on submitted information and available data;
- the scoring system may not account for all legal or factual circumstances;
- no reliance should be placed on any score as a substitute for professional legal advice.
7. Limitation of Liability
7.1 To the maximum extent permitted by law, Uninsurance shall not be liable for:
- unsuccessful claims;
- legal costs;
- delayed outcomes;
- losses suffered;
- reliance on assessments;
- third-party conduct; or
- interruptions to the Platform.
7.2 Users utilise the Platform entirely at their own risk.
8. Intellectual Property
8.1 All intellectual property relating to the Platform remains the property of Uninsurance or its licensors.
8.2 No content, branding, systems, methodologies, or software may be copied or reproduced without prior written consent.
9. Privacy
9.1 Users acknowledge that personal information may be collected, processed, and shared for purposes connected to:
- claim assessments;
- legal referrals;
- consultations;
- fraud prevention;
- support services; and
- legal compliance.
9.2 Information may be shared with:
- PVW Attorneys Inc;
- legal practitioners;
- assessors;
- experts;
- recovery specialists; and
- service providers.
9.3 Uninsurance processes information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”).
10. Amendments
10.1 Uninsurance may amend these Terms from time to time.
10.2 Continued use of the Platform constitutes acceptance of any amendments.
11. Governing Law
11.1 These Terms shall be governed by the laws of the Republic of South Africa.
11.2 Any disputes shall be subject to the jurisdiction of the South African courts.
